Terms of Service

1. Scope

These Terms of Service are intended for business sellers using Makr3D for 3D-print manufacture, packing and dispatch. They should be read with the Privacy Policy, Data Processing Addendum, Acceptable Use Policy, IP & Takedown Policy, Product Compliance Policy, API Terms, Cookie Policy, Returns & Disputes policy and Print Specification.

2. Who we are

Makr3D is operated by Yorkshire3D Limited, a company registered in England and Wales with company number 15466679. Registered office: 53 Woodlea Avenue, Huddersfield, West Yorkshire HD3 4EF, United Kingdom. VAT number: GB444532404. Legal and support contact: [email protected].

3. What Makr3D does

Makr3D provides a UK-based 3D-print fulfilment service for sellers. The service may include file intake, quote generation, Print options, Print Intelligence checks, production review, FDM printing, QA, packing, shipping labels, tracking and seller support. We may also offer API access, order-source connections, private product libraries, creator or catalogue features and revenue-share catalogue access.

Unless a separate written agreement says otherwise, Makr3D is not your marketplace, reseller, agent, distributor, consumer-facing retailer, importer of record for your buyers, or seller of record. You set your listing, price, buyer terms, refund policy, product claims and customer support route.

4. Who may use Makr3D

Makr3D is intended for business use. By creating an account or placing an order, you confirm that you are acting in a business or professional capacity, that you can bind the business you represent, and that your account details are accurate. We may ask for identity, business, tax, payment, safety, rights or marketplace information where needed for fraud prevention, compliance, billing or production review.

5. Your responsibilities as seller of record

You are responsible for:

• your listings, marketing claims, product descriptions, images and prices;
• the rights, licence or permission to manufacture and sell each design;
• consumer-law obligations owed to your buyers;
• tax, customs, import, export, marketplace and platform rules that apply to you;
• product safety, labelling, warnings, age grading and compliance evidence;
• accurate order data, delivery addresses, files, specifications and instructions;
• keeping API keys, staff accounts and integrations secure.

6. Private fulfilment, hosted catalogue and revenue share

Most seller orders are private fulfilment: you list and sell the item on your own Etsy, Shopify, marketplace or direct store, then send Makr3D the order for manufacture. In that model Makr3D acts as your contract manufacturer and fulfilment provider. We require a rights attestation and may investigate obvious issues or complaints, but we do not normally require licence evidence for every private order by default.

Hosted catalogue, mini-store, creator catalogue and revenue-share models are higher risk because Makr3D may host, promote, list, grant access to, or share revenue from the product. Those items are subject to stricter review. We may require provenance, licence documents, creator agreements, product compliance evidence, takedown handling, stronger moderation and written approval before the item can be surfaced through Makr3D.

7. Quotes, Print options and production review

Quotes and Print options are based on the information available at the time, including file geometry, selected material, colour, nozzle, quantity, dispatch method, packaging, queue state and rate tables. A quote is not a guarantee that a file is printable, lawful, compliant, safe, rights-cleared or finally accepted for production.

Production starts only after payment or credit approval and our production review. We may hold, cancel, refuse, re-quote, split or request changes to an order if a file is unsafe, unprintable, materially different from the quote, suspected to breach our policies, affected by stock or machine constraints, or affected by legal, safety, customs or carrier issues.

8. Print Intelligence and automation

Print Intelligence and related automated checks may analyse uploaded files, slicer outputs and production settings to help estimate risk and recommend print settings. Those tools support human review and do not replace it. A recommendation, pass result, estimate or dashboard status is not a promise that a product will pass final inspection or comply with laws in every destination.

9. 3MF, files and production specification

Where you provide a Bambu Studio or OrcaSlicer 3MF file, we aim to honour compatible plate layout, orientation, supports, material, colour and other settings where it is technically possible and suitable for our farm. We may override or reject settings where needed for safety, machine compatibility, quality, stock, policy compliance or realistic production. The Print Specification contains the launch manufacturing limits and finish expectations.

10. Billing, VAT and payment authority

You must pay the fulfilment and shipping fees quoted at order time, together with any adjustments you approve. Prices may be shown excluding VAT, with VAT added where applicable. If you save a payment method, you authorise Makr3D and our payment provider to charge it for approved orders, imports, agreed adjustments and retries. Failed payment may delay, park or cancel production.

If we introduce additional paid services in future, such as subscriptions, API plans or catalogue features, we will give you notice of the pricing and only charge you where you agree to take the service.

We may correct obvious pricing, tax, shipping or currency errors before production. If a production hold requires a different price, we will ask for approval where required by the workflow.

11. Shipping, customs and destination support

Makr3D ships from the United Kingdom to supported destinations only. Destination support may change because of carrier availability, sanctions, customs rules, product category, size, weight, fraud risk, weather, industrial action or local restrictions. Delivery estimates are estimates, not guaranteed delivery dates.

You are responsible for ensuring that products may lawfully be sold, exported, imported and delivered to the destination. Customs duties, import taxes, broker fees and local buyer disclosures may apply. We may refuse shipments where we believe a destination, product or party creates legal, sanctions, export-control or carrier risk.

12. Returns, remakes and disputes

Your buyer relationship stays with you. Buyer returns are handled under your own buyer-facing returns policy and support process. Makr3D handles seller support, carrier claims where we bought the label, production faults and remake requests as described in Returns & Disputes. We do not normally contact your buyer directly unless needed for delivery, safety, legal or fraud reasons.

13. Intellectual property

You retain ownership of your files and grant Makr3D a limited licence to quote, check, manufacture, pack, ship, support and keep records for your orders. You warrant that you have the rights needed for each file and listing. The IP & Takedown Policy explains the private fulfilment and hosted catalogue distinction in more detail, including fan, character and brand-IP treatment.

14. Data protection

The Privacy Policy explains how we handle personal data. Where you send buyer delivery data for fulfilment, you are normally the controller for that buyer data and Makr3D acts as processor for fulfilment and related support. Makr3D remains controller for our own account, billing, fraud, security, legal, safety, analytics and business records. The Data Processing Addendum forms part of these terms where UK GDPR processor terms are required.

15. Acceptable use and product compliance

You must not use Makr3D for prohibited, unlawful, unsafe, infringing or restricted items except where expressly approved in writing. We may refuse weapons, weapon accessories, regulated goods, counterfeit goods, food-contact claims, medical claims, PPE claims, children's products, safety-critical components, export-controlled items or destination-restricted products. The Acceptable Use Policy and Product Compliance Policy set out the main categories.

16. API, integrations and webhooks

API access is permission-based and revocable. You are responsible for keys, credentials, integration configuration, idempotency, retries and webhook handling. API responses, quote estimates, print checks and order-source imports are subject to payment, validation and production review. The API Terms apply to all API and integration use.

17. Suspension and termination

We may throttle, hold, suspend, restrict or close accounts, products, integrations, API keys or orders where needed for payment, fraud, abuse, security, legal, safety, IP, product compliance, tax, sanctions, export-control, carrier or platform reasons. We may preserve records where needed for disputes, legal claims, audits, safety investigations, tax or accounting.

18. Disclaimers and liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, Makr3D is not liable for indirect loss, loss of profit, marketplace suspension, buyer complaints, product recall, regulatory action, customs seizure, IP claim, tax issue or downstream loss caused by your files, listings, claims, rights warranties, buyer terms, destination choices or instructions.

Our total liability for a specific order should not exceed the amount paid to Makr3D for that order, except where a higher cap is required by law or agreed in writing.

19. Changes

We may update these terms as the product, legal environment and launch scope develop. Material changes will be notified through the platform, by email or by posting an updated policy. Continued use after the effective date means you accept the updated terms.

20. Governing law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction where that choice is enforceable. Mandatory local laws may still apply to you, your buyers, your listings, privacy rights, product safety, consumer rights, customs, taxes, sanctions or marketplace activity.
